Eligibility Criteria for Green Card

Green Card eligibility includes the following:

  • Form I-130, Petition for Alien Relative
  • Form I-140, Immigrant Petition for Alien Worker
  • Form I-730, Refugee/Asylee Relative Petition
  • Form I-589, Application for Asylum and for Withholding of Removal

Other petitions include:

  • Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant
  • Form I-526, Immigrant Petition by Alien Entrepreneur
  • Form I-918, Petition of U Nonimmigrant Status
  • Form I-929, Petition for Qualifying Family Member of a U-1 Nonimmigrant

Citizenship

Eligibility Criteria for Citizenship

Congress has the constitutional duty to “establish a uniform Rule of Naturalization”. Art. I, §8, cl.4. To qualify for naturalization, an applicant:

  1. Must be a lawful Permanent Resident;
  2. Must be 18 years or older;
  3. Must meet Continuous residence and physical presence requirements;
  4. Must meet the good moral character requirements;
  5. Must be attached to principles of constitution and well disposed to good order and happiness of the U.S.;
  6. Must be willing to bear arms, perform noncombatant service or work of national importance;
  7. Must not otherwise be barred;
  8. Must demonstrate knowledge of English language, U.S. history and government;
  9. Must take Oath of Allegiance.
